Terms of Service

1. Who you are contracting with

Increment is provided by Stefany Nizamova, a sole trader based in the United Kingdom ("I", "me"). By using Increment you agree to these terms.

Purchases are sold and processed by Lemon Squeezy acting as merchant of record. Lemon Squeezy is the seller for the purposes of your payment, and handles invoicing and any sales tax or VAT. Their terms apply to the transaction itself.

2. What Increment is

Increment is a calendar and planner that schedules flexible work — tasks, goals, habits — around your fixed commitments. It runs on your device. An account is optional, and is used to keep your calendar in step across more than one device.

3. Your licence

Subject to these terms, you are granted a personal, non-exclusive, non-transferable licence to use Increment on devices you own or control. A one-off licence does not expire and there is nothing to renew. A subscription licence is valid while the subscription is active.

Either way, what you buy is a licence to use Increment rather than the software itself, so a licence can only run for as long as Increment does. “One-off” means there is no recurring payment and no expiry date — not that the product is guaranteed to exist indefinitely. Section 8 says what happens if I ever have to stop.

You may not:

• share, resell or sublicense your licence key;
• circumvent the licence check, or use Increment without a valid licence;
• reverse engineer the software except to the extent the law expressly permits.

A licence key is a credential. Anyone who has yours can use it, so keep it to yourself.

4. Payment, renewals and refunds

Increment is sold in two forms: a one-off purchase and a subscription. Both give you the same app — they differ only in how you pay and in what happens if you stop. Prices are shown at the point of purchase.

A subscription renews until you cancel. You can cancel at any time from the link in your purchase email or through Lemon Squeezy's customer portal, and you keep access until the end of the period you have paid for.

Refunds are handled by Lemon Squeezy as merchant of record — they took the payment, so they issue the refund. Request one using the receipt Lemon Squeezy emailed you, or write to me at [email protected] and I will arrange it with them.

Cancellation rights. As a consumer buying digital content online you normally have 14 days to change your mind. Digital content is the exception: under the Consumer Contracts Regulations 2013 that right ends once supply has begun with your consent. Because Increment is delivered immediately, Lemon Squeezy's buyer terms — which apply to your purchase — provide that by downloading or otherwise acquiring the product you consent to immediate performance and lose the right of withdrawal from that point.

That is the legal position rather than my policy, and it does not stop me refunding somebody. Lemon Squeezy may also issue a refund at their discretion for a period after purchase; their buyer terms are the current word on that.

Beyond that, if Increment does not do what it is described as doing, say so. I would rather refund somebody than leave them with something that does not work for them. Your statutory rights under the Consumer Rights Act 2015 are unaffected by anything in this section.

5. Your data

Your calendar, tasks and goals are yours. They are stored on your device, and copied to your account only if you sign in. What is held, where, and how to delete it is set out in the Privacy Policy.

Keep your own backups. Increment stores your calendar in your browser's local storage, which you or your operating system can clear. If you have no account, that copy is the only one.

6. Connected calendars

Connecting a Google or Microsoft calendar is optional. When you do:

• Access is read-only. Increment cannot and does not create, change or delete anything in your calendar.
• Only the calendars you tick are read.
• You can disconnect at any time, in the app or at the provider.
• You are responsible for having the right to connect the account you connect. If it is a work or school account, your employer's policies may apply, and you should check before connecting it.

Google and Microsoft are independent services. If they change their terms, their pricing or their APIs, or restrict access, that may affect what Increment can do — and is outside my control.

7. Acceptable use

You agree not to use Increment to break the law, to infringe anyone's rights, or to attack, overload or probe the service or the accounts of others.

8. Availability

Increment is built to keep working when the network does not: the app runs from your device and does not need the server to draw the screen. Syncing, sign-in and calendar connections do need it, and those are provided on a reasonable-efforts basis without a guaranteed level of availability.

The licence check needs the network about once a day. If Increment cannot reach the server it keeps working normally for seven days from the last successful check, and after that goes read-only until the next one succeeds. Your calendar stays on screen and nothing is deleted, exactly as in section 10. Editing comes back on the next successful check, and you never re-enter your key.

I may change, add or remove features over time. If I ever discontinue the service entirely I will give reasonable notice and a way to get your data out.

If Increment is discontinued

I run Increment on my own. If it ever stops — whether I choose that or circumstances force it — a one-off licence ends with it, because there is no Increment left to license. That is the honest limit of what one person can promise, and "lifetime" here refers to the product's.

If it comes to that, I intend to:

• give at least 60 days’ notice, in the app and by email to the address on your payment account;
• keep a way to export your data available for the whole of that period;
• where I reasonably can, publish a final build that runs without the licence check, so a copy you have already installed keeps working offline afterwards;

None of this affects your rights under the Consumer Rights Act 2015, and it does not apply to a licence I end because of a breach under section 10.

9. Liability

Increment helps you plan. It is not a substitute for your own judgement, and you should not rely on it alone for anything critical — check that appointments are where you think they are.

Your legal rights come first. Some liabilities cannot be limited by a contract, and nothing in these terms attempts to limit them: your rights under the Consumer Rights Act 2015, and liability for fraud or for death or personal injury caused by negligence, all stand whatever else this document says.

If Increment loses your data. Where a fault in Increment destroys or corrupts your calendar, I do not try to exclude liability. Losing your calendar is the thing this app exists to prevent, and a clause excluding liability for it would not be worth the words it took. The Consumer Rights Act 2015 gives you rights where digital content is faulty or damages other content you hold, and they apply here in full.

This is about Increment failing. It is not about a copy you or your operating system deleted — section 5 covers that, and it is why signing in is worth doing.

Two things are worth knowing about that situation. The events in your connected Google or Outlook calendar are not at risk, because Increment only ever reads them and has no ability to change or delete anything there (section 6) — so what is at stake is Increment's own copy, not your underlying calendar. And where a loss was one you could reasonably have avoided — for instance by signing in, so that your calendar exists on more than one device rather than only in one browser's storage — that is taken into account.

Otherwise, and so far as the law allows: I am not liable for indirect or consequential loss, or for loss of profit or business, and my total liability to you is limited to whichever is the greater of the amount you paid for Increment in the twelve months before the claim arose, and the price you paid for your licence.

If you use Increment for business

Consumer protections exist for consumers. If you are using Increment wholly or mainly for the purposes of a business, trade or profession then you are not a consumer, the Consumer Rights Act 2015 does not apply to your purchase, and the following applies to you in place of the two paragraphs above about data loss:

Increment is provided as it is, with no warranties beyond those that cannot lawfully be excluded. I am not liable to you for loss of profit, revenue, business, goodwill, anticipated savings or data, nor for any indirect or consequential loss, however arising. Keeping your own backups and verifying anything you depend on is your responsibility. The cap set out above applies to you as well.

The paragraph headed Your legal rights come first applies to everyone, business or not — those liabilities cannot be excluded against anybody.

10. Ending this agreement

You may stop using Increment at any time. I may suspend or end your licence if you materially breach these terms — in practice, only for the sort of conduct described in section 7, and I will tell you why.

If a subscription lapses you are not locked out. Increment becomes read-only: your calendar, your history and everything you have logged stay on screen, and syncing still brings down changes made on your other devices. What stops is making new ones. Nothing is deleted, and renewing picks up exactly where you left off — you do not need to re-enter your key.

The same applies if I end a licence under this section. You can ask me to erase what is held on the server at any time, whether or not you still hold a licence.

11. Changes to these terms

I may update these terms. If a change materially affects you, I will give notice in the app or by email before it takes effect. Continuing to use Increment after that means you accept the updated terms.

12. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the UK or in the EU, you keep the benefit of any mandatory protections of your own country's law, and may bring proceedings there.
